Terms of Service

Welcome to Holy Music International. These Terms of Service (“Terms”) govern your access to and use of the websites, applications, digital products, educational programs, software, resources, and other services provided by Holy Music International LLC (“HMI,” “Holy Music International,” “we,” “us,” or “our”).
By accessing or using our Services, creating an account, purchasing a product or subscription, or otherwise engaging with our Services, you agree to these Terms. If you do not agree to these Terms, you should not use the Services.


1. Our Services
Holy Music International provides products and services designed to equip artists, songwriters, worship leaders, musicians, and other music professionals.
Our Services may include, without limitation:
HMI Artist Manager and related artist-management technology;
Artist Launch Academy and other educational programs;
courses, workbooks, templates, videos, and digital resources;
artist development resources and services;
music-industry education and career-planning tools;
artificial intelligence and automated career-assistance features;
integrations with third-party platforms;
events, workshops, consulting, and other services; and
future products and services offered by Holy Music International.
Features and availability may change over time.


2. Eligibility and Accounts
You must provide accurate and current information when creating an account or purchasing our Services.
You are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account. You agree to notify HMI promptly if you believe your account has been accessed without authorization.
You may not impersonate another person, create an account using false information, or use another person's account without permission.
If you are under the age required to enter into a binding agreement where you live, your use of paid HMI Services must be authorized by a parent or legal guardian.


3. HMI Artist Manager
HMI Artist Manager provides tools intended to assist artists with areas such as career planning, releases, marketing, audience development, booking, business administration, and career organization.
Artist Manager may generate recommendations, priorities, roadmaps, insights, drafts, analyses, or other information based on information you provide and information obtained through services you choose to connect.
These tools are intended to assist your decision-making. They do not replace your own professional judgment.
HMI does not guarantee that following a recommendation will result in increased streams, followers, bookings, revenue, record deals, publishing agreements, career opportunities, or any other particular result.


4. Artificial Intelligence and Automated Features
Certain HMI Services may use artificial intelligence, algorithms, automation, or other technology to analyze information and provide recommendations or content.
AI-generated information may occasionally be incomplete, inaccurate, or unsuitable for a particular situation. You are responsible for reviewing important outputs before relying upon them or using them publicly.
Unless expressly authorized by you, HMI will not intentionally use automated features to take consequential external actions on your behalf that require your approval.
HMI does not provide legal, financial, tax, accounting, medical, or other regulated professional advice through its AI features.


5. Connected Third-Party Services
HMI may allow you to connect third-party accounts or services, which may include social media platforms, streaming platforms, Google services, distributors, rights organizations, and other music-industry services.
When you connect an account, you authorize HMI to access information permitted by the permissions you approve.
You remain responsible for your relationship with those third-party services and for complying with their respective terms and policies.
HMI does not own or control third-party platforms and is not responsible for their availability, policies, actions, outages, API changes, or decisions to restrict or terminate access.
You may disconnect supported integrations as made available through HMI or the applicable third-party provider.


6. Purchases and Payments
Certain HMI Services require payment.
By purchasing a product or service, you agree to pay the price presented to you at checkout, including applicable taxes or fees.
Prices, product offerings, and promotional offers may change from time to time. Changes will not retroactively alter a completed one-time purchase.
Payment processing may be provided by third-party payment processors and platforms.


7. Subscriptions
Certain Services, including HMI Artist Manager, may be offered through recurring subscriptions.
By purchasing a recurring subscription, you authorize the applicable payment method to be charged according to the billing frequency disclosed at checkout until the subscription is canceled.
You may cancel a subscription according to the cancellation options provided through HMI or the applicable billing platform.
Unless otherwise stated at the time of cancellation, cancellation stops future renewals and access may continue through the end of the already-paid billing period.


8. Refunds
Refund eligibility, where applicable, will be determined by the refund terms presented with the particular product or service and applicable law.
Except where otherwise stated or required by law, access to digital products, downloadable resources, educational materials, and subscription periods that have already been delivered may be non-refundable.
Nothing in these Terms limits rights that cannot legally be waived under applicable consumer-protection law.


9. Educational Content and Results
HMI provides education, tools, strategies, and resources intended to help users develop their careers.
Individual results vary substantially based on factors including talent, effort, consistency, audience, market conditions, implementation, financial resources, experience, and circumstances outside HMI's control.
HMI therefore does not guarantee specific levels of revenue, streams, followers, engagement, bookings, placements, contracts, audience growth, or career success.
Testimonials, examples, case studies, and illustrations are not guarantees that another user will achieve identical results.


10. HMI Intellectual Property
Unless otherwise stated, the HMI Services and materials made available through them—including software, branding, designs, educational materials, videos, workbooks, frameworks, templates, graphics, written materials, and other HMI-created content—are owned by or licensed to Holy Music International and are protected by applicable intellectual-property laws.
Purchasing or accessing an HMI product gives you a limited, personal, non-exclusive, non-transferable license to use the material for its intended purpose.
You may not, without authorization:
resell or redistribute HMI materials;
publicly upload paid HMI content;
reproduce substantial portions of HMI courses or resources for commercial use;
share paid account access with unauthorized users;
copy HMI software or proprietary systems;
remove copyright or proprietary notices; or
represent HMI materials as your own.


11. Your Music and Content
You retain ownership of your music, recordings, compositions, lyrics, artwork, documents, information, and other original content that you submit to HMI.
Using HMI does not transfer ownership of your music or copyrights to Holy Music International.
You grant HMI a limited license to host, process, analyze, transmit, and display your submitted content only as reasonably necessary to provide, maintain, secure, and improve the Services, subject to our Privacy Policy.
You represent that you have the rights necessary to provide any content you upload or connect to the Services.
Nothing in these Terms creates a recording, publishing, management, distribution, or other representation agreement between you and HMI unless you and HMI separately enter into such an agreement.


12. Feedback
If you voluntarily provide suggestions, ideas, or feedback concerning HMI's Services, HMI may use that feedback to develop or improve its products without an obligation to compensate you.
This provision does not give HMI ownership of your songs, recordings, creative works, or other artist content.


13. Acceptable Use
You may not use HMI to:
violate applicable law;
infringe another person's intellectual-property or privacy rights;
access another user's account without authorization;
distribute malware or attempt to compromise HMI's systems;
scrape or extract HMI content in an unauthorized manner;
circumvent access restrictions or security measures;
interfere with the operation of the Services;
use HMI to facilitate fraud, harassment, or other unlawful conduct; or
commercially exploit HMI's proprietary materials without authorization.
We may suspend or terminate access where reasonably necessary to protect HMI, its users, third parties, or the security and integrity of the Services.


14. Privacy and Data
Our collection and use of personal information is described in the Holy Music International Privacy Policy.
When you connect third-party services, HMI may receive information that you authorize those services to provide.
Users may also request deletion of eligible personal data according to HMI's Data Deletion Instructions.
The Privacy Policy and Data Deletion Instructions should be read together with these Terms.


15. Communications
By providing your contact information, you agree that HMI may send communications necessary to provide the Services, including account, security, purchase, subscription, and service-related notices.
Where required by law, promotional communications will be subject to separate consent and applicable opt-out rights.
16. Availability and Changes to the Services
We work to keep HMI Services available and reliable, but uninterrupted availability cannot be guaranteed.
We may modify, improve, add, suspend, or discontinue features as HMI evolves. Where a change materially affects a paid Service, we will handle the change consistent with applicable law and any commitments made at purchase.


17. Disclaimer of Warranties
To the fullest extent permitted by law, HMI Services are provided on an “as is” and “as available” basis.
HMI does not warrant that the Services will always be uninterrupted, error-free, completely secure, or suitable for every user's particular career objectives.
Nothing in this section excludes warranties or rights that cannot legally be excluded.


18. Limitation of Liability
To the fullest extent permitted by applicable law, Holy Music International and its owners, officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.
To the fullest extent permitted by law, HMI's aggregate liability arising from a paid Service will not exceed the amount you paid HMI for the applicable Service during the twelve months immediately preceding the event giving rise to the claim.
These limitations do not apply where applicable law prohibits them.


19. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Holy Music International and its officers, employees, contractors, and affiliates from claims, liabilities, damages, and reasonable expenses arising from your unlawful use of the Services, your violation of these Terms, or content you submit that infringes another person's rights.


20. Suspension and Termination
You may stop using HMI at any time.
HMI may suspend or terminate access when a user materially violates these Terms, engages in fraudulent or unlawful activity, threatens the security of the Services, or creates substantial risk to HMI or other users.
Termination does not automatically eliminate payment obligations or other provisions that by their nature should survive termination.


21. Changes to These Terms
We may update these Terms as HMI and its Services evolve.
The “Last Updated” date at the top of this page will identify the most recent revision. When required by law, we will provide additional notice of material changes.
Continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.


22. Governing Law
These Terms and your use of the Services are governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict-of-law principles.
To the extent permitted by applicable law, any legal action or proceeding arising out of or relating to these Terms or the Services will be brought in a court of competent jurisdiction located in the State of Michigan.
Nothing in this section limits any rights or remedies available to consumers that cannot lawfully be waived or restricted.


23. Entire Agreement
These Terms, together with the Privacy Policy and any additional terms presented for a particular HMI product or service, constitute the agreement between you and HMI concerning your use of those Services.
A separate signed agreement between you and HMI, such as an artist-management, production, publishing, licensing, or consulting agreement, may contain additional terms and will control where it expressly conflicts with these general Terms.
